At Moises, we want to give you the best possible experience to ensure that you enjoy our service and your other interactions with us. Your privacy and the security of your personal data is, and will always be, enormously important to us. So, we want to transparently explain in this Privacy Policy (the “Policy”) how and why we gather, store, share and use your personal data - as well as outline the controls and choices you have around when and how you choose to share your personal data.

2. About this Policy

This Policy applies to personal data that Moises Systems Inc. and/or its affiliates (collectively, “Moises”) collect across all websites, apps, products, and services operated by Moises, including, without limitation, the Moises App and Music.ai (referred to collectively in this Policy as the 'Moises Service’), as well as personal data that Moises collects when you otherwise interact with us, such as if you apply for a job with us, request customer support through any of our available support channels, or communicate with us at conferences or via social media platforms.


Please note that this Policy only applies to Moises. If you use third party products and services that may link to or integrate with the Moises Service (such as software that integrates with the Moises Service, third-party authentication or payment services, or sharing options offered by social media platforms) or if you use a Moises Service account managed by your employer or another entity, what information is collected by such third party provider or such employer or other entity and how it is used is not controlled by Moises. Be sure to review the privacy practices of these third parties to better understand how those third parties collect, use, or share your information.

3. Personal data we collect from you

The information we collect may vary, depending on the particular portions of the Moises Service you use or how you choose to otherwise interact with us. When you create an account, purchase a Moises Service, visit our websites, connect to the Moises Services, contact us, or otherwise interact with Moises (whether directly or indirectly through a third party), we may collect the categories of personal data described below.

This is the personal data that is provided by you or collected by us to enable you to access, sign up for, and/or use the Moises Service. Depending on the type of Moises Service plan you sign up for, this may include your username, email address, phone number, birth date, title, gender, street address, country, and a profile picture.

Some of the personal data we will ask you to provide is required in order to create your account. You also have the option to provide us with additional personal data in order to make your account more personalized.

The exact personal data we will collect depends on the type of Moises Service plan you sign up for, how you create an account, and whether you use third-party services (such as Facebook, Twitter, Google) to sign up and use the Moises Service. If you use a third-party service to create an account, we will receive personal data via that third party service but only when you have consented to that third party service sharing your personal data with us. Please note that the available plans and sign-up options may differ by country

  • Information about your type of Moises Service plan, if applicable.

This also may include details of your use of third-party applications in connection with the Moises Service.
  • Inferences drawn about your interests and preferences based on your usage of the Moises Service.

Please note that we will only access your files from your device if you give us permission to do so, and we will only access media files that you specifically choose to upload to the Moises Service and metadata related to those files, such as the type of file and the size of media file.
  • Certain technical data, which may include:
    • URL information;
    • online identifiers including cookie data and IP addresses;
    • information about the types of devices you are using such as unique device IDs, network connection type (e.g. wifi, 3G, LTE, Bluetooth), provider, network and device performance, browser type, language, information enabling digital rights management, operating system, and Moises application version (if applicable);
    • device attributes of devices on your wifi network that may be available to connect to the Moises Service (such as speakers); and
    • your non-precise location, which may be derived or inferred from certain technical data (e.g., your IP address, the language setting of your device, or payment currency), to comply with geographic requirements in our licensing agreements, and deliver personalized content and advertising to you.

We may collect certain personal data if you sign up for a Trial or purchase any of our paid subscriptions to the Moises Service or make other purchases through the Moises Service. The exact personal data collected will vary depending on the payment method (e.g. direct via your mobile phone carrier or by invoice) but will include information such as:

  • Date of birth;
  • Credit or debit card type, expiration date, and certain digits of your card number;
  • Postal code;
  • Mobile phone number; and
  • Details of your purchase and payment history.

Linked Account
Data

Where we have enabled such integrations, you may choose to link an account you have with a third party with your Moises account, to enable you to import, export, or otherwise process content more effectively. The personal data we collect to enable such integrations may vary depending on the integration, but will include information such as a username or an account ID for the applicable integrated service you are linking to you Moises account.

Contests, Surveys, and Sweepstakes Data

When you complete any forms, respond to a survey or questionnaire, or participate in a contest, we collect the personal data you provide, including your name, contact information (such as email or social media handle), and any other information you submit.

Communications
Data

If you communicate with or contact us, whether via the Moises Service, our support center, our social media accounts, at a conference, or otherwise, we will collect information about you, such as your social media handle, email address, phone number or other contact information, as well as the contents of any such communications.

Candidate Data

If you apply for a job with Moises, we will collect personal data you submit in connection with such application, which may include your name, contact information, employment history, resume and CV data, and other related information.

Other Data

We will also collect any other information you choose to share with your, with your consent. This may include if you participate in a training session with us, provide us feedback regarding our Moises Service, or otherwise send us personal data.

5. Sharing your personal data

Publicly available information

The following personal data will always be publicly available on the Moises Service if you have created an account with us: your name and/or username, and profile picture.

Personal data you may choose to share

The following personal data will only be shared with the categories of recipients outlined in the table below if:

  • you choose to make use of a specific Moises Service feature where sharing of particular
    personal data is required for the proper use of the Moises Service feature; or
  • you grant us your permission to share the personal data, e.g. by requesting we perform
    a specific function, selecting the appropriate setting in the Moises Service or
    authorizing Moises through a presented consent mechanism.

Third-party applications and devices you connect to your Moises Account

If you connect your Moises account to a third-party application and/or device(s), such as social media, audio, television, or automotive platforms and services, Moises shares technical data with the operator of that third party application and/or device in order to connect your Moises account, and/or facilitate playback of the Moises Service. With respect to certain third parties that may request or require that we share your information with them, your permission will be requested before we provide your information to such third parties.

Support community

When you register for a Moises Support Account on the Moises Support Community, we will ask you to create a specific Moises Support Community username. This will be publicly displayed to anyone who accesses the Moises Support Community along with any questions or comments you post.

We share personal data with service providers who need access to certain personal data in order to provide their services to us. These companies include those we've hired to provide customer service support, operate the technical infrastructure that we need to provide, monitor, analyze, and improve the Moises Service and our other products and services, assist in protecting and securing our systems and services, help us manage our customer relationships, and help market Moises’s own products and services as well as partner products, services, events, and co-branded promotions in which Moises is involved.

Payment processors

We will share your personal data with our payment processors as necessary to enable them to process your payments, disputes, and for anti-fraud purposes.

Advertising partners

We work with advertising partners to enable us to customize the advertising content you may receive on the Moises Service. These partners help us deliver more relevant ads and promotional messages to you, which may include interest-based advertising (also known as online behavioral advertising), contextual advertising, and generic advertising on the Moises Service. We and our advertising partners may process certain personal data to help Moises understand your interests or preferences so that we can deliver advertisements that are more relevant to you.

Other Moises group companies

We will share your personal data with other Moises group companies to carry out our daily business operations and to enable us to maintain and provide the Moises Service to you.

Law enforcement and data protection authorities

We share your personal data when we in good faith believe it is necessary for us to do so in order to comply with a legal obligation under applicable law or respond to valid legal processes, such as a search warrant, a court order, or a subpoena. We also share your personal data where we in good faith belief that it is necessary for the purpose of our own, or a third party’s legitimate interest relating to national security, law enforcement, litigation, a criminal investigation, protecting the safety of any person, or to prevent death or imminent bodily harm, provided that we deem that such interest is not overridden by your interests or fundamental rights and freedoms requiring the protection of your personal data.

Purchasers of our business

We will share your personal data in those cases where we sell or negotiate to sell our business to a buyer or prospective buyer. In this situation, Moises will continue to ensure the confidentiality of your personal data and give you notice before your personal data is transferred to the buyer or becomes subject to a different privacy policy.

6. Your preferences and your rights

Moises offers several options for you to express your preferences and make choices regarding how Moises uses your personal data, including:

  • Notification Settings (accessible when logged into the Moises Service) - Allows you to choose which marketing communications you receive from Moises. You may toggle these settings to opt-in or out of receiving different types of email and push notifications. You can use the Notification Settings page to exercise choices about all categories of email and push marketing communication. Please note that if you opt-out of marketing communications, Moises may still send you non-marketing communications, such as those about your account or purchases.
  • Promotional Emails - Email marketing messages from Moises also include an opt-out mechanism within the message itself (e.g. an unsubscribe link in the emails we send to you). Please note that if you opt-out of email marketing, Moises may still send you non- marketing emails, such as those about your account or purchases.
  • Cookies – We use cookies and other similar technologies on our website sand services for a number of purposes, including enhancing website navigation, analyzing website usage, improving experience, enhancing the security of our services and assisting in our marketing efforts. Our Cookie Policy provides more information on how we use cookies, including for interest-based advertising, and how you can manage your cookie preferences and opt-out of certain types of tracking.

In addition, depending on where you reside, you may have rights available to you pursuant to your applicable local law. For more information, please review the Location-Specific Notices section below.

7. Data retention and deletion

We keep your personal data only as long as necessary to provide you with the Moises Service and for legitimate and essential business purposes, such as maintaining the performance of the Moises Service, making data-driven business decisions about new features and offerings, complying with our legal obligations, and resolving disputes. We keep some of your personal data for as long as you are a user of the Moises Service. For example, we keep your media and processed files and account information.

If you request, we will delete or anonymize your personal data so that it no longer identifies you, unless we are legally allowed or required to maintain certain personal data, including situations such as the following:

  • If there is an unresolved issue relating to your account, such as an outstanding credit on your account or an unresolved claim or dispute we will retain the necessary personal data until the issue is resolved;
  • Where we need to retain the personal data for our legal, tax, audit, and accounting obligations, we will retain the necessary personal data for the period required by applicable law; and/or,
  • Where necessary for our legitimate business interests such as fraud prevention or to maintain the security of our users.
  • To request the deletion of your account, please follow the instructions provided at this link if you are using the Moises App. If you do not have the app, you may access this link to open a request; select the option "Account & Login," and on 'Request Type' select "I want to delete my account."

8. Transfer to other countries

Moises shares your personal data globally with Moises group companies in order to carry out the activities specified in this Policy. Moises may also subcontract processing to, or share your personal data with, third parties located in countries other than your country. Your personal data, therefore, may be subject to privacy laws that are different from those in your country.

9. Other Important Details

Third Party Websites and Services - We may display advertisements from third parties and other content that links to third-party websites, and/or offer integrations that allow you to connect an account you have with a third party’s products and services with your Moises account. We cannot control or be held responsible for third parties’ privacy practices and content. If you click on a third-party advertisement or link that causes you to leave the Moises Service and/or provide personal data to a third party’s products or services (even if linked to your Moises account), any personal data you provide will not be covered by this Policy. Please read the privacy policy of the applicable third party to find out how they collect and process your personal data.


Advertising and Analytics Services Provided by Others - We engage others to provide analytics services via the Moises Service and otherwise on our websites, and to serve advertisements on our behalf on other websites and online services. These entities use cookies, web beacons, device identifiers and other technologies to collect information about your use of our Moises Service and other websites and online services, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in apps, links clicked and conversion information. For example, we use Google Analytics. See Google’s privacy policy for more information about how Google collects and uses data about you when you use the Moises Service or our other websites or online services.

10. Keeping your personal data safe

We are committed to protecting our users’ personal data. We implement appropriate technical and organizational measures to help protect the security of your personal data; however, please note that no system is ever completely secure. We have implemented various policies including pseudonymization, encryption, access, and retention policies to guard against unauthorized access and unnecessary retention of personal data in our systems.

Your password protects your user account, so we encourage you to use a strong password that is unique to your Moises account, never share your password with anyone, limit access to your computer and browser, and log out after having used the Moises Service.

11. Children

The Moises Service is not offered to children whose age makes it illegal to process their personal data or requires parental consent for the processing of their personal data under applicable data protection and privacy laws in their country or region of residence (for each such country or region, the “Age Limit”).

We do not knowingly collect personal data from humans under 13 years or under the applicable age limit (the “Age Limit”). If you are under the Age Limit, please do not use the Moises Service, and do not provide any personal data to us.

If you are a parent of a child under the Age Limit and become aware that your child has provided personal data to Moises, please contact us using the form at help.moises.ai.

If we learn that we have collected the personal data of a human under the age of 13 years, we will take reasonable steps to delete the personal data. This may require us to delete the Moises account for that person.

upon where you reside:

This section provides additional disclosures for and details about rights afforded to residents of certain US states, including, without limitation, California consumers under the California Consumer Privacy Act or “CCPA,”, as well as the California Privacy Rights Act or “CPRA”, Colorado residents under the Colorado Privacy Act or “CPA”, Connecticut residents under the Connecticut Data Privacy Act or “CTDPA”, Oregon residents under the Oregon Consumer Privacy Act or “OCPA”, and Virginia residents under the Virginia Consumer Data Protection Act or “VCDPA.”

Categories of Third Parties To Whom We May Disclose Your Personal Information: We may disclose your personal information to the categories of third parties described in the Sharing your personal data section above.

 

Your Rights: The following rights may be available to you, depending on the state in which
you reside, subject to certain limitations and exceptions allowed by law:

  • Access: The right to access the personal data we process about you, along with information about how we process your personal data and the categories of personal data we process, including access in a portable format.
  • Correction: The right to request that we correct inaccurate or incomplete personal information we process about you.
  • Deletion: The right to request that we delete personal data about you.
  • Opt-Out of Sale: The right to opt-out of sales of your personal information. However, we do not sell the personal information we collect, within the meaning of any state laws. We will not sell personal information in the future without changing this Policy and providing any residents of California or other applicable states the right to opt out of such sales.
  • Opt-Out of Sharing /Targeted Advertising: The right to opt-out of sharing of your personal information or use in targeted advertising. However, we do not disclose your personal information to third parties for cross-contextual behavioral advertising (i.e. “sharing” within the meaning of the CCPA) or otherwise use personal information we collect from you for purposes of targeted advertising (within the meaning of other state laws). We will not “share” or otherwise use your personal information for targeted advertising in the future without changing this Policy and providing any residents of California or other applicable states the ability to opt out of such sharing or use.
  • Appeals: The right to appeal any refusal by Moises to take action on a request to exercise the rights afforded to you under the VCDPA within a reasonable period of time. You may exercise your right to appeal by submitting your request to appeal to Moises via any of the methods described in the How to contact us section below. We will inform you in writing of any action taken or not taken in response to your appeal, along with a written explanation of the reasons for our decisions. If your appeal is denied, you may contact the Virginia Attorney General to submit a complaint.

If you wish to submit a request to exercise any of the rights above, please contact Moises using any of the methods described in the How to contact us section below. Please note that prior to taking action on any privacy-related request, Moises takes steps designed to verify the identity of the individual making the request, to limit fraudulent activity and protect the personal data of our users. If we are unable to verify the requestor’s identity, we will not proceed with the applicable request.

 

Non-Discrimination: Moises will not discriminate against any consumer for exercising their rights.


Automated Decision Making: Moises does not engage in automated decision making for “significant decisions” or other decisions that produce legal or similarly significant effects concerning a consumer.


De-identified Data: Moises may use de-identified data in some instances. Moises either maintains such data without attempting to re-identify it or treats such data as personal data subject to applicable law.


Advertising/Analytics: Please note that we may use cookies and related technologies set by other companies for other types of advertising and analytics, as further described in the Advertising and Analytics Services Provided by Others section above. However, based in part on how we’ve configured their technologies, these companies have committed to only use the data they receive via our products and services for the limited business purpose of providing services to us.


European Economic Area ("EEA"), United Kingdom ("UK"), and Switzerland
Moises Systems, Inc. is the data controller of your personal data. For information regarding the legal bases we use to process various types of personal data, please refer to the What we use your personal data for section above.

International Transfers: Personal data collected within the EEA, UK and Switzerland may be transferred to and processed by Moises and/or third parties located in a country outside of the European Union and Switzerland. In such instances, Moises shall ensure that any transfer of your personal data is carried out in accordance with applicable privacy laws and, in particular, that appropriate contractual, technical, and organizational measures are in place with any such third parties, such as the Standard Contractual Clauses or similar transfer mechanisms approved by the applicable data protection authorities.

Rights: The following rights may be available to you, depending on the state in which you reside, subject to certain limitations and exceptions allowed by law, subject to certain limitations and exceptions allowed by law:

  • Access: The right to access the personal data we process about you, along with
    information about how we process your personal data and the categories of personal
    data we process, including access in a portable format.
  • Correction: The right to request that we correct inaccurate or incomplete personal
    information we process about you.
  • Deletion: The right to request that we delete personal data about you.
  • Restriction: The right to request that we restrict processing of your personal data, such
    as by limiting to storing but not further processing.

    provide that data in a structured, commonly used and machine-readable format, and
    you have the right to transmit that data to another controller.
  • Objections: The right to object to our processing, such as if you object to our
    processing based on legitimate interests or our direct marketing.

    revoke that consent.

Please note that prior to taking action on any privacy-related request, Moises takes steps designed to verify the identity of the individual making the request, to limit fraudulent activity and protect the personal data of our users. appropriate under the circumstances, e.g., by displaying a prominent notice within the Moises
Service or by sending you an email and/or a device notification. We may notify you in advance.
